HighGround provides business-to-business software that helps Amazon advertisers analyze advertising performance, manage campaigns, evaluate profitability, generate optimization recommendations, and, where enabled by the customer, make changes to Amazon advertising accounts.

2. Scope of This Privacy Policy
This Privacy Policy applies to personal information processed by HighGround through its website, application, services, account administration, sales, support, marketing, and related business operations.
Certain information HighGround receives through Amazon APIs is also subject to Amazon's applicable developer agreements, data protection requirements, policies, and contractual restrictions.
When HighGround processes information on behalf of a business customer, the customer may independently have privacy obligations relating to that information.
Where an agency or other service provider connects an Amazon account belonging to its client, the agency is responsible for having the client's authorization to do so and for providing any privacy notices its clients require. In that context, HighGround processes the client's information to provide the Service at the agency's direction, as described in the HighGround Terms of Service.
3. Information We Collect
The information we collect depends on how you interact with HighGround.
3.1 Information You Provide Directly
We may collect information that you provide to us, including:
- full name;
- business name;
- business email address;
- telephone number;
- job title or professional role;
- account information;
- billing information;
- customer support communications;
- sales inquiries;
- feedback;
- information submitted through forms;
- preferences and settings; and
- other information you choose to provide.
3.2 Account Information
When you create or use a HighGround account, we may collect information such as:
- name;
- email address;
- account identifier;
- company or organization;
- account type;
- authentication information;
- subscription status;
- account settings;
- connected Amazon advertising profiles;
- permissions;
- login timestamps;
- IP addresses; and
- account activity.
Passwords, where used, are stored using appropriate cryptographic protection rather than in plain text.
3.3 Amazon Advertising and Seller/Vendor Information
When a customer connects an Amazon account, HighGround may receive data through authorized Amazon APIs.
Depending on the account type, permissions granted, and services used, this may include:
- Amazon Advertising profile information;
- marketplace identifiers;
- campaigns;
- campaign status;
- ad groups;
- keywords;
- search terms;
- targeting information;
- bids;
- budgets;
- impressions;
- clicks;
- advertising spend;
- attributed sales;
- conversion information;
- advertised products;
- purchased products;
- ASIN information;
- sales and traffic information;
- product performance;
- organic sales information;
- Best Sellers Rank or similar product information;
- shipped revenue or cost-of-goods information where available;
- advertising and product performance history; and
- other information made available through Amazon APIs that is necessary to provide the Service.
HighGround accesses Amazon information only pursuant to permissions authorized by the applicable Amazon account and subject to Amazon's applicable policies and agreements.
HighGround does not request or store Amazon customer personal information or Restricted Data. HighGround does not collect buyer names, email addresses, telephone numbers, or shipping or billing addresses, and does not use Restricted Data Tokens.
3.4 Payment Information
HighGround may use third-party payment processors such as Stripe to process fees and subscriptions.
HighGround may receive information such as:
- customer identifier;
- transaction amount;
- transaction date;
- payment status;
- invoice information;
- subscription status;
- billing address;
- limited payment-method metadata; and
- payment failure or dispute information.
HighGround does not receive or store complete payment card numbers or security codes. Card details are collected directly by Stripe.
3.5 Website and Device Information
When you visit our website, we or our service providers may automatically collect information such as:
- IP address;
- browser type;
- browser version;
- operating system;
- device type;
- language;
- approximate geographic location derived from IP address;
- referring website;
- pages viewed;
- time and date of visits;
- links clicked;
- buttons clicked;
- form interactions;
- conversion events;
- cookie identifiers;
- advertising identifiers; and
- similar browser or device information.

3.6 Application Telemetry
The authenticated HighGround application may generate operational information necessary to operate, secure, maintain, and improve the Service.
This may include:
- authentication activity;
- API activity;
- system logs;
- errors;
- diagnostics;
- feature usage;
- processing status;
- integration health;
- synchronization history;
- job execution information;
- security events; and
- application performance information.
HighGround does not use advertising pixels inside the authenticated application to create advertising audiences from customer Amazon data or customer business information.
3.7 Communications
If you communicate with HighGround, we may retain:
- emails;
- support tickets;
- messages;
- meeting notes;
- feedback;
- requests;
- complaints; and
- other business communications.
4. How We Use Information
HighGround may use information to:
- provide and operate the Service;
- create and maintain customer accounts;
- authenticate users;
- connect authorized Amazon accounts;
- retrieve and process authorized Amazon data;
- analyze advertising performance;
- calculate reporting metrics;
- generate recommendations;
- perform advertising optimization;
- execute customer-authorized advertising actions;
- measure advertising profitability;
- provide dashboards and reports;
- maintain historical performance records;
- process payments and subscriptions;
- provide customer support;
- communicate about accounts and services;
- respond to inquiries;
- detect and prevent fraud;
- protect HighGround, customers, and users;
- maintain system security;
- diagnose technical problems;
- monitor system performance;
- improve the Service;
- conduct internal business operations;
- measure website usage;
- measure marketing effectiveness;
- conduct advertising where permitted;
- comply with legal requirements;
- enforce agreements; and
- establish, exercise, or defend legal claims.
5. Automated Analysis and Advertising Optimization
HighGround uses automated software, algorithms, statistical models, and other computational processes to analyze advertising and commerce information.
These systems may be used to:
- identify advertising performance patterns;
- evaluate campaign efficiency;
- identify potential wasted advertising spend;
- recommend keyword changes;
- recommend bid adjustments;
- recommend budget adjustments;
- identify advertising opportunities;
- evaluate product or campaign performance;
- calculate profitability; and
- generate other optimization recommendations.
Where customers enable functionality that permits HighGround to make changes through Amazon APIs, HighGround may execute authorized advertising actions according to the customer's selected account settings and the Service configuration.
HighGround does not represent that automated recommendations or actions will produce any specific business, advertising, revenue, profit, or sales result.
Certain of these workflows use a third-party artificial intelligence provider, OpenAI. HighGround sends limited catalog and keyword text to OpenAI for semantic processing and keyword generation, including product titles, bullet points, descriptions, product and category context, and keyword strings. HighGround does not send general account data, bids, advertising spend, or full advertising performance datasets to a third-party artificial intelligence provider.
6. How We Disclose Information
HighGround may disclose information in the following circumstances.
6.1 Service Providers
We may disclose information to service providers that perform services on our behalf, such as:
- cloud infrastructure and hosting;
- database services;
- secrets management;
- email delivery;
- artificial intelligence and semantic processing;
- payment processing; and
- other operational services necessary to provide the Service.
These providers may process information only as permitted by their agreements with HighGround and applicable law.
6.2 Amazon
HighGround communicates with Amazon systems when a customer connects an Amazon account.
Information may be transmitted between HighGround and Amazon as necessary to:
- authenticate accounts;
- retrieve authorized information;
- synchronize advertising information;
- obtain reports; and
- execute customer-authorized changes.
Amazon processes information according to its own agreements, policies, and privacy practices.
6.3 Payment Processors
Information necessary to process billing and payments may be disclosed to payment processors such as Stripe.
6.4 Analytics and Advertising Providers
HighGround may use analytics and advertising technologies on its marketing website, including technologies provided by Google, Meta, TikTok, and similar providers.
Depending on your consent choices, these providers may receive online identifiers, device information, website activity, advertising interactions, and related information.
Certain disclosures through advertising technologies may constitute a "sale," "sharing," targeted advertising, or similar regulated activity under applicable United States state privacy laws.
HighGround does not sell personal information for monetary consideration.

6.5 Legal Requirements
We may disclose information if we reasonably believe disclosure is necessary to:
- comply with applicable law;
- respond to lawful legal process;
- comply with court orders or government requests;
- investigate fraud or unlawful activity;
- protect the rights, property, or security of HighGround;
- protect customers or users; or
- establish, exercise, or defend legal claims.
6.6 Business Transactions
Information may be transferred as part of a merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar business transaction.
6.7 With Your Direction or Consent
We may disclose information where you direct us to do so or provide consent.
7. Customer and Amazon Data Restrictions
HighGround treats customer Amazon advertising and business data separately from marketing-site visitor data.
HighGround does not use customer Amazon advertising data, Amazon-sourced data, or other confidential customer business information to build advertising audiences for HighGround or unrelated third parties.
HighGround does not place Meta Pixel, TikTok Pixel, Google advertising tags, or similar advertising pixels inside the authenticated HighGround application for the purpose of tracking customer Amazon data or customer business activity for behavioral advertising.
HighGround does not use one customer's non-public Amazon data to generate customer-specific insights, benchmarks, recommendations, or competitive intelligence for another customer in a manner that would disclose or expose the first customer's non-public information.
HighGround may use aggregated or de-identified information where permitted by applicable agreements and law, provided the information cannot reasonably be used to identify a customer, individual, advertiser, or protected source and the use complies with applicable Amazon restrictions.
8. Cookies, Analytics, and Advertising Technologies
HighGround uses cookies and similar technologies as described in our Cookie Policy.
These technologies may include:
- strictly necessary cookies;
- local storage;
- session storage;
- Google Tag Manager;
- Google Analytics;
- Google advertising and measurement technologies;
- Meta Pixel;
- TikTok Pixel; and
- similar tags or tracking technologies.
Optional analytics or advertising technologies are subject to HighGround's consent-management controls where applicable.
HighGround uses a consent framework under which applicable advertising technologies are denied by default unless the visitor provides the required consent.
Visitors may change their choices through the persistent privacy controls available on the website.
HighGround also recognizes qualifying Global Privacy Control signals where required by applicable law.

9. Google Analytics and Measurement Technologies
HighGround may use Google Analytics and related Google technologies to understand how visitors interact with the marketing website and to measure website and marketing performance.
Depending on configuration and your consent choices, Google may receive information such as:
- IP address;
- device information;
- browser information;
- pages viewed;
- referring source;
- website interactions;
- session information; and
- online identifiers.
HighGround may use Google Consent Mode v2 to communicate consent choices to applicable Google technologies.
Where consent is required, relevant Google consent signals are denied by default unless the visitor affirmatively grants the applicable permission.
10. Advertising Technologies
HighGround may use advertising technologies such as Meta Pixel, TikTok Pixel, and Google advertising technologies on the marketing website.
These technologies may be used for:
- conversion measurement;
- advertising attribution;
- campaign measurement;
- advertising optimization;
- audience creation;
- remarketing where permitted; and
- evaluating the effectiveness of marketing campaigns.
Advertising technologies may transmit website activity and online identifiers to their respective providers.
These technologies do not operate inside the authenticated HighGround application for the purpose of creating advertising audiences from customer Amazon advertising data or other customer business information.
For purposes of this Section, the pre-login signup and login pages at app.highgroundapp.com are treated as part of the HighGround marketing website and may use the analytics and advertising technologies described above. These technologies are not used inside the authenticated HighGround application for advertising or cross-context behavioral advertising purposes.
11. Your Privacy and Consent Choices
Visitors can control optional tracking through HighGround's privacy and consent interface.
Where implemented, visitors may:
- accept optional technologies;
- reject optional technologies; and
- change previously selected preferences.
A persistent Your Privacy Choices or similar link is available on the website for changing applicable preferences.
Rejecting or withdrawing consent will prevent applicable advertising technologies from operating going forward, subject to technical limitations, necessary technologies, information previously processed, and applicable law.
12. Global Privacy Control
Global Privacy Control ("GPC") is a browser-based signal that communicates certain privacy preferences.
Where required by applicable law, HighGround recognizes a valid GPC signal as a request to opt out of the sale or sharing of personal information associated with the browser or device transmitting the signal.
When applicable, advertising technologies used for activities constituting sale or sharing will remain disabled for that browser or device while the applicable GPC signal is present.
Because GPC operates at the browser or device level, users may need to enable it separately on each browser or device.
13. Data Security
HighGround uses administrative, organizational, technical, and physical safeguards designed to protect information against unauthorized access, alteration, disclosure, loss, or misuse.
Security measures may include:
- password hashing;
- role-based access control;
- tenant-scoped application access;
- secure authentication cookies;
- authentication rate limiting;
- application and action logging;
- dedicated secrets management for Amazon credentials;
- card collection handled by the payment processor so card numbers do not pass through HighGround systems; and
- encrypted connections when communicating with Amazon, payment processors, and other service providers.
No system can guarantee absolute security, and HighGround cannot guarantee that unauthorized access, security incidents, or data loss will never occur.
14. Data Retention
HighGround retains information only for as long as reasonably necessary for the purposes for which it was collected, including to:
- provide the Service;
- maintain customer accounts;
- maintain historical reporting;
- fulfill contractual obligations;
- maintain security records;
- prevent fraud;
- comply with legal obligations;
- maintain financial and tax records;
- resolve disputes; and
- enforce agreements.
Retention periods may vary depending on:
- the category of information;
- the customer's account status;
- contractual requirements;
- Amazon requirements;
- security requirements;
- legal obligations; and
- legitimate operational needs.
Information may be deleted, anonymized, or aggregated when it is no longer reasonably necessary to retain it.
Amazon Selling Partner API Information is deleted within 30 days after HighGround's authorization to access the applicable Amazon account is revoked or terminated.
Retention of Customer Data following cancellation or termination of a HighGround account, including deletion timelines for Amazon-sourced data, is described in Section 11.5 of the HighGround Terms of Service.
15. De-Identified and Aggregated Information
HighGround may create de-identified or aggregated information where permitted by applicable law and contractual requirements.
Where information is maintained as de-identified information under applicable privacy law, HighGround will maintain and use it in de-identified form and will not attempt to re-identify it except as permitted by law, including where necessary to evaluate the effectiveness of de-identification controls.
16. Children's Privacy
HighGround is a business-to-business service and is not directed toward children.
HighGround does not knowingly collect personal information from children under 13 through the Service.
HighGround also does not knowingly sell or share, as those terms are defined under applicable privacy laws, personal information belonging to consumers under 16 years of age.
If we learn that we have collected personal information from a child in violation of applicable law, we will take reasonable steps to delete the information.
17. International Users
HighGround is based in the United States.
If you access HighGround from outside the United States, information may be transferred to, stored in, or processed in the United States or other countries where HighGround or its service providers operate.
Privacy laws in those jurisdictions may differ from those in your location.
Where required, HighGround will implement appropriate safeguards for international transfers of personal information.
HighGround currently offers the Service to business customers in the United States, Canada, and Mexico and does not actively market the Service to businesses in the European Union, European Economic Area, or United Kingdom.
18. United States State Privacy Laws
HighGround is primarily a business-to-business service, but certain United States state privacy laws may apply to some individuals or information.
Depending on applicable law, residents may have rights relating to:
- access;
- correction;
- deletion;
- portability;
- targeted advertising;
- profiling;
- sale of personal information; and
- sharing of personal information.
HighGround does not sell personal information for monetary consideration.
However, disclosures involving certain advertising technologies may be treated as a "sale," "sharing," targeted advertising, or similar regulated activity under applicable state privacy laws even where HighGround receives no money for the information.
HighGround provides applicable privacy choices through the privacy controls available on its website.
18.1 California Residents
This section supplements this Privacy Policy for California residents and is intended to address the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the "CCPA").
For purposes of this section, "personal information," "sell," "share," "business," "service provider," "contractor," and related terms have the meanings assigned to them under the CCPA.

HighGround or advertising providers may generate limited inferences based on website interactions or advertising activity.

Categories of personal information that may be sold or shared, as those terms are defined by the CCPA, include:
- identifiers and online identifiers;
- Internet or electronic network activity;
- approximate geolocation information; and
- inferences related to online activity, where applicable.
Categories of third parties to which this information may be disclosed include:
- advertising networks;
- social media platforms;
- analytics providers;
- advertising measurement providers; and
- marketing technology providers.
These providers may include Google, Meta, TikTok, and their applicable affiliated entities.
HighGround does not knowingly sell or share personal information belonging to consumers under 16 years of age.
E. Right to Opt Out of Sale or Sharing
California residents have the right to direct HighGround not to sell or share their personal information.
You may exercise this right through the Your Privacy Choices, Do Not Sell or Share My Personal Information, or similar privacy control available on the HighGround website.
You do not need to create a HighGround account to exercise an applicable browser or device-level opt-out right.
Where an opt-out applies, advertising technologies used for activities constituting sale or sharing will be prevented from operating for those purposes, subject to applicable law and technical limitations.
F. Global Privacy Control
HighGround recognizes qualifying Global Privacy Control signals where required by California law.
When HighGround receives an applicable GPC signal, we treat it as a request to opt out of sale or sharing for the browser or device transmitting the signal.
G. California Privacy Rights
Subject to applicable exceptions, California residents may have the following rights:
Right to Know and Access
You may request information regarding personal information HighGround has collected about you.
Right to Delete
You may request deletion of personal information collected from or about you, subject to applicable exceptions.
Right to Correct
You may request correction of inaccurate personal information maintained about you.
Right to Opt Out of Sale or Sharing
You may direct HighGround not to sell or share your personal information.
Right to Limit Certain Uses of Sensitive Personal Information
Where applicable, California residents may have rights concerning certain uses or disclosures of sensitive personal information.
HighGround does not use sensitive personal information for purposes that require offering a limitation right unless otherwise disclosed.
Right to Non-Discrimination
HighGround will not discriminate against you for exercising rights provided by the CCPA.
H. Service Provider and Contractor Processing
When HighGround processes personal information on behalf of a customer through the HighGround application, HighGround may act as a service provider or contractor under the CCPA.
That role is distinct from HighGround's collection of information through its own:
- marketing website;
- sales activities;
- account administration;
- analytics activities; and
- advertising activities.
For those activities, HighGround may act as a business under the CCPA.
I. Verification
For requests to know, access, delete, or correct personal information, HighGround may take reasonable steps to verify the identity of the person submitting the request.
Verification may include matching information provided in the request against information maintained by HighGround.
HighGround may deny a request where verification is legally required and HighGround cannot reasonably verify the requester.
Requests to opt out of sale or sharing generally do not require identity verification, although HighGround may need information necessary to apply the request to the appropriate browser, device, account, or personal information.
J. Authorized Agents
California residents may use an authorized agent to submit privacy requests where permitted by law.
HighGround may require reasonable evidence that the agent is authorized to act for the consumer and may require the consumer to verify their identity or confirm authorization where permitted.
K. Retention
HighGround retains each category of personal information only for as long as reasonably necessary and proportionate to the purposes for which it was collected or processed, subject to legal, contractual, security, accounting, tax, dispute-resolution, and operational requirements.
L. California Shine the Light
California Civil Code Section 1798.83 permits certain California residents to request information regarding disclosures of personal information to third parties for their own direct marketing purposes.
HighGround does not disclose personal information to third parties for their own direct marketing purposes in a manner subject to this provision.
This statement does not alter the separate disclosures concerning analytics and advertising technologies addressed under the CCPA's sale and sharing provisions.

20. Third-Party Websites and Services
The HighGround website or application may contain links to third-party websites or services.
HighGround does not control and is not responsible for the privacy practices of third parties.
This Privacy Policy does not govern information collected directly by third parties under their own policies and services.
21. Changes to This Privacy Policy
HighGround may update this Privacy Policy as:
- our services change;
- our technology changes;
- our data practices change;
- laws change; or
- our legal obligations change.
The "Last Updated" date at the beginning of this Privacy Policy identifies the most recent revision.
For material changes, HighGround will provide at least 30 days' advance notice before the change becomes effective, unless a shorter period is reasonably necessary because of law, security concerns, Amazon requirements, fraud prevention, or another urgent circumstance. Notice may be provided by email, through the Service, or by a notice on the website.
